NGO law
The firm provides legal assistance related to the operation of non-governmental organisations (NGOs), including foundations and associations.
The law firm’s NGO law activities include:
- advising on commencing business in Poland, in particular with choosing the legal form for the planned activity,
- drafting the necessary documents to establish a non-governmental organisation, in particular statutes and resolutions or other documents appointing members of bodies,
- registering organisations in the National Court Register,
- registering organisations in the register of UBOs,
- making amendments to statutes and changes in the composition of the bodies of the organisation, registering changes and representing organisations in proceedings (before the National Court Register),
- advising on obtaining the status of a public benefit organisation and on conducting activities having obtained that status,
- preparing documentation related to meetings of the organisation's bodies and internal acts regulating the functioning of the bodies,
- creating organisational units of associations and representative offices of foreign foundations; liquidating organisations,
- drafting, verifying and negotiating all kinds of agreements and annexes to agreements related to the functioning or activity of the organisation, including donation, sponsorship, loans, grants, subsidies, service and cooperation agreements, leases, insurance and bank agreements,
- providing day-to-day advice on the organisations’ projects, in particular those related to humanitarian aid, medical aid, education, culture, media, protection of human rights and housing,
- representing organisations in administrative proceedings and in discussions with governmental authorities and agencies or local governments (towns/municipalities, counties and provinces),
- advising on labour law,
- registering trademarks,
- advising on copyright and industrial property law,
- representing organisations before courts and public administration authorities,
- representing organisations in disputes with members of the organisation's bodies.
